Article 1 Who am I?

BMD Media B.V. is a private limited company located at Witte Vlinderweg 51, (1521 PS) Wormerveer. I am registered with the Chamber of Commerce under number 71289836. I am the data controller for your personal data.

Article 2 What data do I use?

Here you can find an overview of the data I process from you, why I do so, the legal basis for processing this data, and how long I will retain it.

I process your name, email, and other necessary data to provide my services to you and fulfill our contractual agreement. This may include login information for systems you want me to work with and social media accounts. I use this data to ensure your satisfaction as a customer throughout the duration of our agreement. I will retain this data for a maximum of 30 calendar days after our agreement ends.

To manage your order, I will retain your name, billing address, email, purchase history, and payment details for 7 years after our agreement ends. This is done for the purpose of fulfilling and potentially modifying the agreement, as well as for tax purposes. Invoices related to digital services will be retained for 10 years.

I use a portfolio on my website and social media channels to showcase previous work to potential clients. If possible, I include the texts I have written for you or screenshots of other content I have created for you, along with your (company) name, provided you have given consent for this when entering into the agreement. I will retain this material indefinitely in my archives unless you request its removal.

For invoicing and financial administration purposes, I process your name or that of your contact person, company name, billing address, Chamber of Commerce number, VAT number, customer number, telephone number, email, bank details, and outstanding balance. Without this data, I cannot process your payment. As per a legal obligation by the Tax Authorities, I am required to retain this data for 7 years. Invoices related to digital services will be retained for 10 years.

In the event that you have a complaint about my services, I will process your name, email, order number, and the content of the complaint in order to provide you with the best possible solution. I use this data for the optimal execution of our agreement. I will delete complaint-related data 1 year after resolution.

BMD Media B.V. has a legitimate interest in using certain personal data for marketing purposes. I process your name, email, and social media account for direct marketing and social media marketing. I will delete this data as soon as you unsubscribe from my newsletter or indicate that you no longer wish to be contacted by me.

To enable and optimize this website, I use analytics and retargeting services. I have a legitimate interest in using your browsing behavior and related data to analyze and improve my service when necessary. I will track your use of my website using Google Analytics and a Facebook Pixel, subject to the retention periods set by Google and Facebook.

These services utilize cookies. Cookies are small pieces of information that are sent to your browser when you visit my website and are stored on the hard drive or in the memory of the device you use to access my website. Access - You can request at any time to access your data from BMD Media B.V.
Modification - If, based on the access granted, you want to have your data adjusted, improved, supplemented, shielded, or deleted, you can make a request for this. You can also modify certain data yourself in your personal account.

Data Portability - If you wish to transfer your data to another provider, I will provide your data in a structured and commonly used format that is accessible by commonly used digital systems.
Automated Processing - You may always let me know your position on an automated decision and have this decision reconsidered by a third party.

I enter into data processing agreements with these third-party processors to protect your privacy to the fullest extent. I will not sell your data to third parties.

One of the processors of BMD Media B.V. is Kajabi. In order to offer you the news letter and courses, I need to transfer your personal data to Kajabi. This only happens when you choose register for a course or add yourself to the newsletter.

Article 6: Automated decision making

BMD Media B.V. may use automated decision-making based on the data and payments provided by you. As a result, some of my services may not be (anymore) available to you.
